Terms of Service

All use of the WPMissionControl Web Application and its content, services, and products available on or through the website are governed by the following terms and conditions. The product, which is a trademark of the Private Entrepreneur PE Kravchenko O.Y., is owned and operated by WPMissionControl. By using the product, you agree to accept all the terms and conditions stated in this Agreement, without any modifications, along with any other operating rules, policies (including, but not limited to, WPMissionControl Privacy Policy), and procedures that WPMissionControl may publish on this Site from time to time.

Before accessing or using the product, carefully review this Agreement. By accessing or using any part of the product, you are agreeing to be bound by the terms and conditions stated in this agreement. If you do not agree to all the terms and conditions, you are not permitted to access the product or use any services. If WPMissionControl’s terms and conditions are considered an offer, acceptance is explicitly limited to these terms.

WPMissionControl maintains the right to amend these terms or any additional terms concerning its product. Such modifications will be implemented promptly and may apply retroactively to all current users.

The failure to immediately enforce these terms does not signify a relinquishment of any rights by WPMissionControl. The company reserves the right to take appropriate action in the future if needed.

In the event that any of these Terms and Conditions are considered invalid or void, the remaining Terms and Conditions will continue to be valid and enforceable.

  1. Your WPMissionControl Account and Site. If you possess an account on the product, it is your responsibility to maintain the security of your account (including email, password, or API keys). You are fully accountable for all activities conducted under your account and any other actions taken in connection with it. It is strictly prohibited to use WPMissionControl services in a misleading or unlawful manner, including any attempts to exploit the name or reputation of others. WPMissionControl reserves the right to modify or delete any content that it deems inappropriate, unlawful, or likely to cause liability for WPMissionControl.
  2. In the event of any unauthorized use of your account or any security breaches, you must promptly inform WPMissionControl. WPMissionControl will not be held liable for any actions or omissions on your part, and any damages resulting from such actions or omissions will be solely your responsibility.
  3. Responsibility of Contributors. When using the product, you bear full responsibility for the following:
    • Providing accurate and valid user data, including email and name.
    • Refraining from engaging in any illegal or abusive activities on the Website.
    • Ensuring the security of your account’s email, password, or API keys.
    • Maintaining a single account and not creating multiple accounts.
  4. WPMissionControl reserves the right, though not obligated, to take the following actions at its sole discretion:
    • Refuse or remove any content (monitors) that WPMissionControl deems, in its reasonable opinion, to violate any WPMissionControl policy or be harmful or objectionable.
    • Terminate or deny access to the products to any individual or entity for any reason, according to WPMissionControl’s sole discretion.
    • In such cases, WPMissionControl will not be obliged to provide a refund for any amounts previously paid.

Services Provided.

WPMissionControl automatically checks the monitors defined by the system in the predefined intervals. And, once a downtime is detected, it can notify the “user-defined contacts” with various methods (like e-mail, SMS, Slack, mobile push messages, etc.). The monitoring methods include:

  1. HTTP(s)/website monitoring
  2. SSL certificate monitoring)
  3. Health Points of a WordPress instance monitoring
  4. Issues monitoring (i.e. New WordPress Version available, File Checksum Changed, Absent File, Alien File etc.)
  5. Status pages (showcase your website health status to your customers)

You have the option to purchase paid plans, which offer additional benefits such as checking more websites and accessing more notification channels (Slack, SMS, etc.). The features available in the paid plans are dependent on the plan tier and may include a specific number of monitored websites, the number of notification channels accessible, and the option to add a Security Badge to your website.

Payment and Renewal.

  1. General Terms.
    • The product offers optional paid services, known as “Upgrades,” which include features like extra monitored websites, additional notification channels, or Security Badge availability. By selecting an Upgrade, you agree to pay WPMissionControl the monthly or annual subscription fees specified for that particular service.
    • Payments for Upgrades will be charged on a pre-paid basis from the day you sign up for the Upgrade and will cover the use of that service for the indicated monthly or annual subscription period. When you request a plan upgrade, the payment method you provided will be charged or credited with the new prorated amount for the current payment period.
    • You will be required to pay the rate for the upgrade from the date of the upgrade until the end of your current billing cycle. Once the purchase is confirmed successfully, you will gain access to your new plan within a short time (subject to our payment processor’s speed). The new rate will be applicable to your next billing cycle.
    • Should you choose to downgrade your plan, the change will be scheduled for your usual renewal date, meaning your current plan will remain active until the end of your prepaid period. The new rate for the downgraded plan will apply and be charged during your next billing cycle.
    • Please note that if the new plan exceeds the limits of your account resources, such as the number of websites or notification channels, we reserve the right to deny the downgrade or suspend resources that exceed the limit. In such cases, this action may be taken automatically without prior notice.
    • WPMissionControl retains the right to modify the payment terms and fees and will notify users of any changes accordingly.
  2. Minimal Hardware and Software Requirements for Using WPMissionControl.
    WPMissionControl has minimal hardware and software requirements for usage. You can utilize WPMissionControl with any operating system, including mobile devices, as long as it can support a modern web browser like Edge, Google Chrome, Safari, or Firefox.
  3. Purchase Process
    • To purchase services from WPMissionControl, you can access the “Upgrade link” after logging in to the product. The purchasing process follows these steps:
    • Choose the desired paid plan.
    • Make the payment for the provided Invoice. Please note that payment options with credit cards, debit cards, and PayPal will be available in a future update, and you will be notified about this update.
    • Once the purchase is confirmed, WPMissionControl will send you an email confirming that the purchased service is now available for use.
  4. As of today, the payments should be processed manually. Automated payment processors will be available at the later stage.
  5. Refunds You have the option to cancel your subscription at any time, and you will not be obliged to pay any additional fees for future subscription renewal periods. However, any subscription fees paid in advance will not be refunded unless the cancellation occurs within 7 days or less since the last payment. Only payments made in the last 7 days or less will be eligible for a refund in such cases.
  6. Delivery Policy. Once your order is received, the services will be provided to you in accordance with the applicable terms for the purchased services. The nature of the services and the purchase date may influence the timing of service delivery. The services will be considered successfully delivered to you upon their activation.
  7. Termination. WPMissionControl reserves the right to terminate your access to all or certain parts of the products at any time, with or without cause, and with or without prior notice, effectively immediately. If you wish to terminate this Agreement or your WPMissionControl account (if applicable), you can do so by simply discontinuing the use of the products. Even after termination, certain provisions of this Agreement that naturally should continue to be in effect will remain in force. These provisions include, but are not limited to, ownership rights, warranty disclaimers, indemnity clauses, and limitations of liability.
  8. Advertisements. WPMissionControl retains the right to show advertisements on your account.
  9. Changes. WPMissionControl reserves the exclusive right to modify or replace any portion of this Agreement, at its sole discretion. It is your responsibility to regularly review this Agreement for any updates. If you continue to use or access the product after any changes are posted, it signifies your acceptance of those modifications. Furthermore, WPMissionControl may introduce new services and/or features through the product in the future, which will also be subject to the terms and conditions of this Agreement.
  10. Intellectual Property. This Agreement does not transfer any WPMissionControl or third-party intellectual property rights to you, and all ownership and rights to such property will remain solely with WPMissionControl, as between the parties. WPMissionControl, the WPMissionControl logo, and all other trademarks, service marks, graphics, and logos associated with WPMissionControl or the products are either trademarks or registered trademarks of WPMissionControl or its licensors. Any other trademarks, service marks, graphics, and logos used in connection with the products may be the trademarks of their respective third-party owners. Your use of the products does not grant you any right or license to reproduce or use any WPMissionControl or third-party trademarks. The intellectual property rights of WPMissionControl and third parties are protected and not transferred to users through this Agreement.
  11. Limitation of Liability. Under no circumstances will WPMissionControl, its suppliers, or licensors be liable for any subject matter of this agreement, regardless of the legal or equitable theory, including but not limited to contract, negligence, or strict liability, for: (i) Any special, incidental, or consequential damages. (ii) The cost of procuring substitute products or services. (iii) Interruption of use or loss or corruption of data. (iv) Any amounts that exceed the fees paid by you to WPMissionControl under this agreement during the twelve (12) month period prior to the cause of action. WPMissionControl shall not be held liable for any failure or delay arising from matters beyond their reasonable control. The limitations mentioned above will not apply to the extent prohibited by applicable law.
  12. Indemnification. You consent to indemnify and hold harmless WPMissionControl, its contractors, licensors, and their respective directors, officers, employees, and agents, from any and all claims and expenses, including attorneys’ fees, arising from your use of the product, which includes but is not limited to any violations of this Agreement.
  13. Disclaimer of Warranties. The product is offered on an “as is” basis. WPMissionControl, along with its suppliers and licensors, explicitly disclaims all warranties, whether express or implied, including but not limited to the warranties of merchantability, fitness for a specific purpose, and non-infringement. Neither WPMissionControl nor its suppliers and licensors provide any guarantee that the products will be free from errors or that access to them will be continuous or uninterrupted. It is important to acknowledge that any content or services downloaded from or obtained through the product is done at your own discretion and risk.
  14. General Representation and Warranty. By using the products, you affirm and guarantee that: (i) Your utilization of the products will adhere strictly to the WPMissionControl Privacy Policy, this Agreement, and all relevant laws and regulations, including local laws or regulations in your country, state, city, or other governmental areas, concerning online conduct, acceptable content, and the transmission of technical data exported from Ukraine or your country of residence. (ii) Your use of the products will not violate or infringe upon the intellectual property rights of any third party.
  15. Contacting WPMissionControl. You can reach WPMissionControl via email at support@wpmissioncontrol.com. By contacting WPMissionControl, you grant them a worldwide, non-exclusive, perpetual right to any ideas, information, designs, or other materials contained in the communication, unless you have obtained prior written agreement from the WPMissionControl board. Please refrain from sharing commercially sensitive information and data about your operations with WPMissionControl. Any information sent to WPMissionControl will not be considered subject to any form of non-disclosure agreement, unless you have obtained prior written consent from the WPMissionControl board. Keep in mind that email communication is not entirely secure, and there is no guarantee of delivery. For your communication to be acknowledged by WPMissionControl, you should receive a manually created response. Unless otherwise indicated by the WPMissionControl board, all discussions conducted via email should be considered informal and non-binding. Any mention or reference to alterations in contractual terms by WPMissionControl should be treated as speculative until you receive written confirmation from the WPMissionControl board.
  16. Miscellaneous. This Agreement represents the complete understanding between WPMissionControl and you regarding its subject matter and can only be modified through a written amendment signed by an authorized executive of WPMissionControl, or by the posting of a revised version by WPMissionControl. Unless applicable law states otherwise, this Agreement, and any access to or use of the product, will be governed by the laws of Ukraine in Shevchenkivsky district of Kyiv city. You have the right to assign your rights under this Agreement to any party that consents to and agrees to abide by its terms and conditions. WPMissionControl also has the authority to assign its rights under this Agreement without any conditions. This Agreement will be binding on the parties and will benefit their successors and permitted assigns.
